大数据发展与公民个人信息刑法保护的利益平衡

摘要
随着现代信息技术的快速发展,公民个人信息表现方式日益复杂,传播途径逐步增多,针对公民个人信息的犯罪也层出不穷,严重影响了公民的安全感和社会稳定。大数据时代需要公民个人信息具有公开性、传播便利性,这势必对公民个人信息的保护形成挑战。应当遵循统筹兼顾略有侧重的基本原则,既要考虑公民个人信息的人身权属性,同时兼顾两者之间的利益平衡,合理配置纳入刑法保护的公民个人信息的范围,全面考虑大数据时代犯罪手段的特征和不同利益主体在公民个人信息利用中的作用,才能处理好大数据发展对数据需求和公民基本权利保护之间的关系。
With the rapid development of modern information technology, citizens' personal information is becoming more and more complex, and the ways of dissemination are gradually increasing. Crimes against citizens' personal information are also emerging in an endless stream, seriously affecting citizens' sense of security and social stability. In the era of big data, citizens' personal information needs to be open and easy to disseminate, which is bound to challenge the protection of citizens' privacy. We should follow the basic principle of overall planning, giving consideration to both the personal right attribute of citizens' personal information and the balance of interests between the two, rationally allocating citizens' personal information into the scope of protection by criminal law, and comprehensively considering the characteristics of criminal means in the era of big data and the role of different stakeholders in the utilization of citizens' personal information, so as to deal with the contradiction between the needs for data and the protection of citizens' basic rights.
