前景理论视阈下医疗纠纷预防的风险识别思考

摘要
作为热点的《医疗纠纷预防和处理条例》最新出台,折射出国家对于医疗纠纷预防处理的决策治理观念发生重大转变,即由原来重处理、轻预防变为预防与处理并重的社会治理轨道,风险识别作为医疗纠纷预防的关键和首要环节应该予以重视。但是目前关于医疗纠纷预防的理论研究及可借鉴的国际经验较少,并且基于中国医改全局来看必要的风险管理政策设计是亟待完善的。以行为经济学的前景理论为研究视阈,重点突出医疗纠纷预防风险识别的前景理论特征,在此基础上从责任构建的角度得出当下医疗纠纷有效预防的相关启示。
The newly promulgated Regulations on the Prevention and Disposal of Medical Disputes, as a hot topic, reflects a significant change in the concept of decision-making and governance in the prevention and disposal of medical disputes, that is, from focusing on disposal to focusing on both of prevention and disposal. Risk identification, as a key and primary link in the prevention of medical disputes, should be paid attention to. However, there are few theoretical studies on the prevention of medical disputes, and the necessary risk management policies need to be improved urgently based on the overall situation of China's health care reform. Therefore, this paper takes the prospect theory of behavioral economics as the research horizon, focusing on the foreground theoretical characteristics of risk identification of medical dispute prevention, and on this basis, from the perspective of responsibility construction, draws implications for effective prevention of medical disputes at present.
