协商行政视域下的裁量规制研究

摘要
行政裁量已然成为行政过程中的常态,一方面,根据行政裁量的特殊性在维护个体正义方面发挥了不可小觑的积极作用;但另一方面,行政裁量易被滥用,容易失范,需加强约束和规制。因此应当通过促进立法革新,转变行政权力中心格局;加强行政自我控制,去除基准制定之悖离风险;强化司法对行政控制的使命感,提升对合理性问题的关注度;倚重参与型的协商行政规制模式等多元化的措施来规制行政裁量权的行使,使其步入法治轨道,发挥应有效用。
Administrative discretion has become the norm in the process of administration, and also an important subject that people have to face in the process of administrative jurisprudence. On one hand, the particularity of administrative discretion has played a positive role in the maintenance of individual justice. On the other hand, due to the easy abuse and anomie of administrative discretion, it should be strengthened and regulated firmly. So we should regulate the exercise of administrative discretion by perfecting legislation regulation, strengthening the self-control abilities of administration and judicial reviews as well as relying on the negotiate administrative regulation mode. Therefore, we can make the administrative discretion into the orbit of rule of law, and play its due utility.
