浅谈道德法律化的界限问题

摘要
"常回家看看"条款等一系列道德法律化的例子表明,在道德法律化的过程中,应当警惕道德泛法律化。道德泛法律化本身有损法律权威,使公民自由受限,增加司法负担,而且法律也非万能,因此需要对道德法律化进行必要限制。基于法的目的,道德法律化必须限于满足公民的社会生活条件。与此同时,道德法律化还应当避免重复立法,必须在有能力保证其有效实施的前提下进行。
A series of ethical legalization examples such as the " Regular Home Visit" clauses show that in the process of moral legalization,we should be alert to the generalization of morality. The generalization of morality itself undermines the legal authority,limits the freedom of citizens,increases the judicial burden. What's more,the law is not omnipotent,so it is necessary to impose necessary restrictions on moral legalization. For the purposes of the law,moral legalization must be limited to satisfying the social living conditions of citizens.At the same time,moral legalization should also avoid duplication of legislation and proceed with the ability to ensure its effective implementation.
