摘要
加强自贸区知识产权行政执法协作,有利于提高行政执法效率,优化自贸区法治化营商环境。基于法治政府理论、协作性治理理论和整体性治理理论,界定了自贸区知识产权行政执法协作的内涵,调研和评析了陕西自贸区知识产权行政执法协作的现状,借鉴上海、福建等地自贸区经验,提出应深化自贸区知识产权综合管理体制改革,构建自贸区跨部门知识产权执法协作多边基础框架,完善既有执法协作机制,建设知识产权保护公共服务平台,加强知识产权执法队伍建设,以完善自贸区知识产权行政执法协作机制。
Strengthening the coordination of intellectual property administrative enforcement in the FTZ is conducive to improving the efficiency of administrative enforcement and optimizing the legalized business environment in the FTZ. Based on the theory of rule of law-based government, the theory of collaborative governance and the theory of holistic governance, the connotation of the coordination of intellectual property administrative enforcement in the FTZ is defined, the status quo of the coordination of administrative enforcement in Shaanxi FTZ is investigated and analyzed. Learning from the experience of Shanghai FTZ and Fujian FTZ etc., it is proposed that the reform of the comprehensive intellectual property management system in the FTZ be deepened, the basic multilateral framework for coordination of inter-departmental intellectual property administrative enforcement be established, the mechanism of the coordination of the existing administrative enforcement be improved, the public service platform for intellectual property protection be built,and the construction of enforcement teams be strengthened, so as to improve the coordination mechanism for intellectual property administrative enforcement in the FTZ.
