论刑事错案责任追究制度

摘要
刑事错案责任追究制度是司法责任制的重要内容,是预防刑事错案的重要一环。我国刑事错案责任追究制度在司法实践中暴露出错案标准不统一、责任追究不明确、追责主体之确立有悖正义原则等问题,这些问题已经严重影响了该制度价值目标的实现。因此,应当统一错案认定标准,划分错案责任,细化惩戒委员会相关机制。
The accountability system for misjudged criminal case is an important part of the judicial responsibility system, as well as a key to preventing misjudged criminal cases. In our judicial practice, many problems of the accountability system for misjudged case have been exposed, such as the standards for misjudged cases are not uniform,accountability is unclear, and determining the subject of responsibility investigation is contrary to the principle of justice, etc. These problems have seriously hindered the realization of the system's value goals, so it is imperative to unify the standards for determining misjudged cases, divide responsibility for misjudged cases, and refine relevant mechanisms for the disciplinary committee.
