摘要

监狱作为国家刑罚执行机关,承担着监管罪犯改造的重要职责。但监狱内出现罪犯"抗改事件"时有发生,给监狱人民警察的执法带来考验与挑战。以衡阳市辖区监狱为实证研究,着力分析当前衡阳市监狱系统"抗改事件"执法面临的现实困境,即思想认识不充分、执法环境不优化、法律法规不完善、突发意外不可测。针对问题,系统地提出了破解"抗改事件"执法困境的有效路径,深化思想认识,制定执法细则,尤其是要尽快探索建立"抗改事件"执法容错纠错机制。
        The prison as the national authority of penal enforcement takes important responsibility of supervising criminals' rehabilitation. However, the incident of criminals' resistance to transformation happens constantly, which brings about much tests and challenges for the prison people's police. This paper firstly takes an empirical study of prisons located on the Hengyang city, focus on analysis of the practical predicaments of the law enforcement of the criminals' resistance to transformation which are confronted by the whole prison system,including awareness of mind not being sufficient, environment of law enforcement not being optimized, relevant laws and regulations not being improved and sudden accidents not being predicable. Finally, this paper puts forwards the effective solutions to solving the dilemma on the law enforcement of the criminals' resistance to transformation pointedly and systematically, inclusive of deepening awareness of mind, formulating the rules of enforcement and establishing the fault-tolerance-and-correction mechanism of the law enforcement of the incident of criminals' resistance to transformation as soon as possible especially.
