摘要

三大诉讼法已将电子数据作为新的证据类型,绝大多数技术规范和法律规定都难以适用于电子数据相关性的判断,电子数据在法庭上也经常受到质疑。在分析了当前电子数据若干法律规定和技术规范后,本文以电子数据的技术特征为出发点,层次化地探讨和分析了电子数据相关性。
        China's three major procedural laws in turn made specific provisions of electronic evidence, establishing the electronic evidence as an independent category of evidences, but the electronic evidence usually have been questioned in the courts because most of the legal rules and technology standards cannot adapt the judgements of relevancy of electronic evidence. After analyzing the current legal rules and technology standards about the electronic evidence, this paper takes the technical characteristics of the electronic evidence as the starting point, discusses the relevancy of electronic evidence with the hierarchical analytical method.
