立法视野下夫妻财产知情权制度建构路径

摘要
随着社会的发展,夫妻财产权利意识日渐提高,夫妻财产知情权问题倍受关注。因夫妻关系多元性、复杂性及特殊性,夫妻财产知情权面临严峻挑战。当夫妻财产知情权与隐私权发生冲突时,应该根据法律法规、公序良俗等原则协调。当前夫妻财产知情权研究仍面临一些困惑与挑战,所以建构夫妻财产知情权路径势在必行。
With the development of society,the awareness of couple's right to know is improving gradually,which makes couple's right to know about each other's property. Since the relationship between husband and wife is complicated and special,such right is seriously challenged often. When the right to know about each other's property is at odds with privacy right,it is essential to coordinate according to certain law or rules.This study raises the issue of confusion and challenge faced by couple's right about each other's property. It explores the approaches to construct couple's right to know about their shared property.
