科创板的五个重要行政法问题

摘要
科创板的设立和运行是我国资本市场改革和证券市场监管改革的试验田,科创板的制度设计围绕着注册制展开,将为各项改革积累经验、树立样本。改革的成败取决于政府职能转变和依法行政的落实程度,文章对科创板制度设计中相关的五个行政法问题展开探讨,认为通过法律制度的进一步完善,可以为科创板的平稳运行和实现如期目标提供更为坚实可靠的制度支撑和保证。
The establishment and performance of the science and technology board is the experiment field for reform of capital market and securities market in China. The system design of the science and technology board focuses on registration system which aims to accumulate experience and to create model for kinds of reform. Whether the reform of the science and technology will success or fail depends on transformation of government function and accomplishment of law-based administration of government. The article discusses five important administrative law issues on the science and technology innovation board and believes that the improvement of legal design can safeguard the better performance of science and technology board.
