夫妻共同债务制度的完善

摘要
2018年1月18日施行的《夫妻债务解释》改变了"第二十四条"对债权人的过度偏爱。然而最高人民法院在夫妻共同债务方面仍存在两大误解,问题之根源是我国缺乏夫妻共同财产管理制度。完善夫妻共同债务制度,应当规定债务人配偶个人财产原则上不对共同债务负责,未用于共同生活的个人债务也能以部分夫妻共同财产清偿。
On January 18,2018,the Interpretation of Marital Joint Debt comes into effect,which reduces the excessive preference to creditors in the "Art. 24". However,the supreme people's court still has two misunderstandings about the marital joint debt. To improve the system of joint debts between husband and wife,it shall be stipulated that the personal property of the debtor's spouse shall not be responsible for the joint debts in principle,and the personal debts that are not used for living together can also be paid off by part of community property.
