摘要

本文以法经济学为分析框架,一方面运用"卡-梅框架"研究硬法的规制与保障,另一方面以经济诱因为标准划分软法的激励规则与助推规则,深入阐释制度的多元功能。从功能视角检视已有制度规范的优劣得失并提出改进建议,有效推进共享医院的良性发展,助推医疗改革、型塑医疗体制,以制度创新之姿落子共建共治共享的社会治理新格局。
        This paper takes law economics as the framework of analysis. On the one hand,it uses the " card-mei framework" to study the regulation and protection of hard law,and on the other hand,it uses economic inducement to divide the incentive rules and boost rules of soft law because of the standard to explain the multiple functions of the system. To examine the advantages and disadvantages of the existing system norms from the functional perspective and put forward suggestions for improvement,effectively promote the healthy development of shared hospitals,promote medical reform and plastic medical system,and build a new pattern of social governance that is shared by common governance and shared by the children in the form of institutional innovation.
