从实证视角反思帮助信息网络犯罪行为的定性

摘要
从我国目前的刑事司法实践来看,帮助信息网络犯罪行为在网络犯罪中整体比例虽然不高,但是帮助手段多样,帮助行为界定复杂,致使该罪名的适用条件争议不断。对于同一类型的案例,有的认定为帮助信息网络犯罪活动罪,有的认定为其他犯罪,存在定罪与量刑的偏差。法官在推理过程中可以运用"以刑制罪"理念,以后果主义论证方法界定帮助行为人罪名,从而解决司法适用之难题。
According to the present practice of criminal justice in China,there is less aiding-type network criminal behavior among the network crimes. However,the controversy over the application of the adding-type crime is continuous due to the various aiding ways and the complexity of defining the adding behavior. For the same case,some people decide it as the adding-type crime while other people think it otherwise,causing the deviation of conviction and penalty measurement. During the reasoning process,the judge can decide the adding-type crime by the concept of " affirming a crime by penalty" and the consequentialist argument so as to solve the difficult problem of the judicial application.
