从实际案例看专利确权程序中“权利要求的进一步限定”式修改

摘要
专利审查指南对于无效阶段权利要求的具体方式修改后,无效实践中,如何理解和把握权利要求的进一步限定式修改,相关从业者存在不同的见解,本文旨在通过无效案例的分析,总结专利局复审无效程序中传达的审查标准,希望对于当事人特别是专利权人提供参考,以便有效利用有限的修改时机修改权利要求以尽最大可能维护权益。
According to Decision of the State Intellectual Property Office on Amending the Guidelines for Patent Examination( 2017), the specific manners of amendment have been changed. There are different understandings on how to further restrict claims in patent invalidation practice, this article aims to summarize admissibility criteria from invalidation decision, and give practice guides to the parties especially patent proprietor, in order to make good use of amendment opportunity within the time limit to maximize interests.
