工业EPC项目常见结算争议及注意事项

摘要
EPC总承包模式近年来在石化、铁路、电力等行业相关工程实施中备受业主青睐,工业项目因其工程费用投资大、工艺复杂、技术先进、设计质量要求高、釜塔器等超常规设备多,且涉及专业领域广(一般包含火电、电力、化工、冶炼、机电安装、市政、环保等领域),为了便于专业化管理,对技术成熟的工业项目基本均采用EPC总承包模式。随着EPC工程承包模式的广泛采用,其在工程结算中存在的争议问题也逐渐浮现出来。通过对青海盐湖金属镁一体化工业园建设中存在的EPC总承包项目结算争议问题进行分析,结合一些典型争议问题的实际处理方式,并从法理角度进行必要说明,进而提出在招标投标合同签订阶段、工程建设阶段、工程结算阶段避免结算争议的注意事项,可为EPC项目各参建方规避结算中出现较大争议提供一定参考。
The EPC general contracting model has been favored by owners in the implementation of projects related to petrochemical,railway, and electric power industries in recent years. Industrial projects always with the large investment, complicated processes, advanced technology, high designing quality requirements, and a large number of ultra-conventional equipments, such as Reaction Cauldrons,Towers. Which also involves a wide range of professional fields(generally including thermal power, electricity, chemicals,smelting, electromechanical installation, municipal administration, environmental protection, etc.), In order to facilitate professional management, EPC general contracting model is basically used in industrial projects of mature technology.With the widespread adoption of the EPC model, the controversial issues in project settlement have gradually emerged. Through the analysis of the settlement disputes of EPC contracting projects in the construction of Qinghai Salt Lake Metal Magnesium Integrated Industrial Park, combining with the actual treatment of some typical dispute issues, and providing some necessary explanations from the legal point of view.Eventually, the points of note for avoiding settlement disputes are put forward during the signing stage, construction stage and settlement stage, which can provide some reference for EPC project participants to avoid major disputes in settlement.
