对生猪注药注水违法行为监管的思考

摘要
近年来,生猪屠宰环节出现了通过注射针剂实现注水的新型生猪注水违法行为,增加了执法监管难度。本文通过剖析生猪屠宰违法注药案例,指出了当前存在违法查处难、药品和问题产品检验难、案件移送难及猪肉水分限量标准有待完善等执法困惑,提出了完善标准,落实待宰静养制度,强化行刑衔接和严格执法等对策建议,以期为优化生猪屠宰监管提供借鉴。
In recent years,a new type of illegal act of injecting drugs into pigs to make water-injected meat appeared in the slaughtering process,which increased the difficulty of law enforcement supervision.In this paper,the illegal cases of drug injection during pig slaughtering were analyzed,and the confusions were pointed out,such as difficulties in the investigation of illegal behaviors,the testing of drugs and defective products and in the transfer of cases,as well as the imperfect limit standard of moisture content in pork,etc.In order to offer reference for optimizing the supervision over pig slaughtering,it was proposed that related standards shall be developed and improved,the rule of feed withdrawal for pigs before being slaughtered shall be implemented,the convergence of administrative law and penal law shall be strengthened,and relevant law enforcement shall be carried out strictly.
