重大行政决策风险评估制度文本分析

摘要
重大行政决策风险评估制度,是评估重大行政决策可行性和防范决策风险的有效手段。通过分析政府《重大行政决策程序规定》和《社会稳定风险评估实施办法》的立法文本,发现我国现行风险评估制度尚存在评估主体不独立、评估内容不明确、评估程序不完善、评估种类不齐全等问题。为了进一步提升风险评估制度的文本质量,使其发挥真正效用,中央和地方还需完善立法、改进程序、加强监督并提升政府法治思维,避免风险评估制度陷入僵化。
The major administrative decision-making risk assessment system is an effective means to assess the feasibility of major administrative decisions and to prevent decision-making risks.Through the analysis of the legislative text of the government's Regulations On Major Administrative Decisions and The Implementation Of The Risk Assessment of Social Stability,it is found that China's current risk assessment system still has some problems such as not independent main body of evaluation,unclear assessment content,imperfect evaluation procedure and incomplete assessment type.In order to further improve the quality of the text of the risk assessment system and make it a real utility,the central and local authorities need to improve legislation,upgrade the procedure,strengthen supervision and improve the government's rule of law thinking,so as to prevent the risk assessment system from becoming rigid.
