侦查讯问语言的开放与闭合——基于38份讯问笔录的实证分析

摘要
侦查讯问是公安机关办理刑事案件的重要环节,将应用语言理论与侦查实践相结合,以38份讯问笔录为语料进行实证分析,发现开放式提问在侦查讯问中信息获取的关键阶段具有重要作用,而闭合式提问多用于程序性问话。只有在理论上全面认识开放式提问和闭合式提问在侦查讯问中的适用情形和注意事项,在实践中合理运用开放式提问和闭合式提问,才能有效提高侦查讯问的工作质量。
Investigative interrogation is an essential part of the public organs' investigation of criminal cases.Combining theory of applied language with the practice of investigation, an empirical analysis is conducted on the basis of 38 interrogation records. The rersult shows that opening questions play a vital role in the key stage of information acquisition, while closing questions are mostly used in procedural questions. Overall theoratcal understanding of applicable situations and precautions of opening questions and closing questions in investigative interrogation, together with reasonable practical application of opening questions and closing questions contribute to effective improvement of investigative interrogation.
