摘要
权力法治源于权力自身的局限性,其实质是良法控权。权力法治有其自身的价值逻辑,一方面为权力运行提供合法性依据,另一方面为公民权利实现提供制度保障,并有效维护权力与权利之间的张力平衡,使公权力与私权利相互制约又相互依存,维持政治体系的内在稳定。权力法治的要义是控权,关键在于形成一个有效的权力运行制约和监督体系。新时代我国推进权力法治,健全权力运行制约和监督体系,应着力完善权力运行的科学配置、程序控制、信息公开、多元监督和责任追究等系列机制。
The power under rule of law originates from the limitations of power itself,and its essence is to control power by good law.The power under rule of law has its own value logic.On one hand,it provides the legitimacy basis for the operation of power;on the other hand,it provides the system guarantee for the realization of civil rights,and effectively safeguards the balance of tension between power and rights.So that public power and private rights are mutually restricted and interdependent,and thus to maintain the internal stability of the political system.The essence of power under rule of law is to control power,and the key is to form an effective system to restrict and supervise power operation.In the new era,China should promote the power under rule of law,improve the restriction and supervision system of power operation,and focus on improving the scientific allocation of power operation,procedure control,information disclosure,multiple supervision and accountability mechanisms.
