湿地产权确权理论基础与实现途径研究

摘要
湿地产权确权是自然资源资产统一确权登记的重要内容之一。由于湿地生态系统处于动态之中,系统结构、权属关系等复杂多样,湿地相关立法模糊,造成湿地空间确权难度极大。按照物权法定、权责清晰、权属衔接和权力连续的原则,明确了湿地确权的对象和内涵,梳理了湿地空间的所有权与用益物权主要类型及依据,在宁夏回族自治区和甘肃省试点的基础上,明确了与不动产登记、自然资源资产登记相关联的湿地产权确权路径。
Wetlands property confirmation is an important part of the uniform property confirmation registration of natural resource assets. Wetlands property is highly difficult to confirm, because of the dynamic wetland ecosystem, various system structures, complex property relations and ambiguous legislation. Based on the principles of statutory real right, clear rights and liabilities, cohesion and continuity, the objects and connotation of wetlands property confirmation are first clarified. Resulting from combining the classification and legal basis of wetland ownership and usufructuary rights as well as the pilot experience in Ningxia Hui Autonomous Region and Gansu province, the feasible approaches of wetlands property confirmation related to real estate registration and natural resource asset registration are finally defined.
