网购消费者个人信息保护的立法建议

摘要
随着大数据时代的到来,网络购物迅猛发展,对消费者个人信息进行保护,不仅能够促进电子商务的健康发展,而且符合世界经济的发展潮流。然而,我国在网购消费者个人信息保护方面,存在立法分散、责任主体不完备、欠缺有效救济途径等问题。在对日本、德国和美国等域外国家相关立法进行研究的基础上,建议我国应尽快出台《个人信息保护法》,明确多方责任主体应承担的责任,并设置有效的救济途径,从而更好地保护我国网购消费者的个人信息。
With the arrival of the era of big data and the rapid development of online shopping, the protection of consumer personal information can not only promote the healthy development of e-commerce, but also conform to the development trend of the world economy. However, there are some problems in the protection of personal information of online shopping consumers in China, such as decentralized legislation, incomplete subject of responsibility, and lack of effective remedies. On the basis of the research on the relevant legislation of Japan, Germany and the United States, it is suggested that China should promulgate the Personal Information Protection Law as soon as possible, clarify the responsibilities of multi-responsible subjects, and set up effective remedies, so as to better protect the personal information of online shopping consumers in China.
