规范化与精细化:大城市政府权力清单升级和优化的重要方向

摘要
提高规范化与精细化水平是大城市政府权力清单由1.0版本向2.0版本升级和优化的必然要求。对北京西城区、上海浦东新区、杭州上城区的权力清单文本进行分析可以发现有比较大的差异,这影响了大城市政府权力清单的规范化与统一性,不利于推进权力清单制度的"可比较、可复制、可推广"。这些差异表现在权力清单的分类、权力清单的总条目数,权力清单中其他行政权力的分类及条目数、不同区相同部门权力清单的总数、以及相同行政权力列出的法律依据等方面。应当从加强顶层设计完善制度建设、完善权力的分类、明晰兜底条款促进"其他行政权力"分类的规范化、优化行政权力运行流程图、推进动态管理等方面,促进大城市政府权力清单的升级和优化,提高大城市权力清单的规范化与精细化水平。
It is a necessary requirement for the Metropolit an Government to improve the standardization and Refinement level of power list system during upgrading and optimizing power list system from version 1.0 to version 2.0 Through the analysis of power lists of Beijing Xicheng District, Shanghai Pudong new area and Hangzhou Shangcheng district, we can see large differences between them,which influence the standardization and unification of Metropolitan Government Power List. This is not conducive for the power list sys-tem to "Comparable, Reproducible, and Extended". These differences are manifested in the classification and total number of power lists,the classification and numbers of other administrative powers in these power lists, the different areas of same Department's total number of power lists, the listed same executive powers of legal basis, and other aspects. According to all above, we are aimed to promote Metropolitan Power List's upgrading and optimization, enhancing its standardization and legalization by strengthening the top-level de-sign, improving the system construction, perfecting the classification of power, clarifying the terms and conditions, promoting classified standardization of "other administrative power", optimizing administrative power flow charts and promoting dynamic management.
