海警部队执法权设定及运行研究

摘要
根据全国人大常委会的授权,武警海警部队(称中国海警局)行使包括海上治安、刑事侦查和海洋行政执法在内的海上维权执法职权。海警部队成为兼具军事、行政和刑事侦查职能属性并统一行使海上综合执法职权的武装执法力量。作为我国海上力量体系改革最新的成果之一,海警部队是武警部队的新质力量,按照远海有效维权、近海高效执法的定位要求,进一步规范和完善执法权运行,是维护国家海洋权益和构建新型海上综合执法力量的有效保障。
In accordance with the authorization of the Standing Committee of the National People's Congress, the Armed police Marine Police Force(known as the China Coast Guard)exercises the functions and powers of maritime law enforcement, including maritime security, criminal investigation and maritime administrative law enforcement. The China Coast Guard has become an armed law enforcement force with military, administrative and criminal investigative functions and unified functions of maritime comprehensive law enforcement. As one of the latest achievements in the reform of China's maritime power system, the maritime police force is a new quality force of the armed police force. According to the positioning requirements of effective protection of rights in the distant sea and efficient law enforcement in the offshore, further standardizing and improving the operation of its law enforcement power is the basis for safeguarding the national maritime rights and interests and building a new type of comprehensive law enforcement force at sea.
