摘要

侦查讯问工作的开展具有显著的法律性与政策性,但有关刑事法律与刑事政策之间的冲突已成为侦查讯问策略与方法发挥最优效能的障碍。反思刑事法律与刑事政策之间的冲突,可促进两者的良性发展。其一,两者要基于相同的价值体系;其二,两者的作用要有明确定位并需对两者进行及时的调整。
        The investigation and interrogation work has significant legality and policy characteristics, but the conflict between criminal law and criminal policies has become an obstacle to the optimal effectiveness of the investigation and interrogation strategies and methods. Rethinking the conflict between criminal law and criminal policy can promote the healthy development of the both. First, the two should be based on the same value system;second, the role of the two must be clearly positioned and the two should be adjusted in a timely manner.
