系统论视阈下现场物证的层次结构分析

摘要
当前以审判为中心的诉讼制度改革要求公安机关在办理刑事案件中,必须以现场物证为核心开展侦查活动,这就急需提高对现场物证的认识和分析水平。从系统论的视角来看待现场物证,运用系统层次观来全面的分析现场物证,为深入挖掘现场物证所蕴含的各种信息开辟了一个新的研究方向,为提高现场物证的证明力提供了新的思路,从而为诉讼审判提供强有力的证据支持。
Nowadays,the innovation of the lawsuit system centering around the judgement makes a new requirement,that is,the policemen should let their work done by surrounding the core of spot's material evidences,which makes a higher demand for the promotion towards the ability of cognizance and analysis. This paper,puts forward a new method for the analysis of the spot's material evidences from the angle of system theory,together with system analytic hierarchy. In this way,a new way of researching the spot's material evidences will be opened up by doing so,and it may also inject a new thought for improving the degree of proof of the spot's material evidence. In a word,it can be in great support for the lawsuit judgment in the matter of evidence.
