多层次诉讼式审查逮捕机制构建问题研究

摘要
通过审查批准逮捕对公安机关的侦查活动进行监督和制约,有利于保障侦查活动的合法公正性,切实保障公民的人身自由。作为一项特殊的司法审查活动,应当从制度上不断完善对审查批准逮捕的规定。文章通过探究多层次诉讼式审查基本机制的内涵及理论、法律依据,结合域外国家审前羁押决定程序的实践,提出凸显开放性、亲历性、诉辩性、可救济性的多层次样态的审查逮捕诉讼化新模式。
To supervise and restrict the investigation activities of the public security organs through examination and approval of arrest is conducive to ensuring the legal and fair nature of investigation activities and to practically guaranteeing the personal freedom of citizens. As a special judicial review activity,we should constantly improve the regulations on the review and approval of arrest. By exploring the connotation,theory and legal basis of the basic mechanism of multilevel litigation review and combining with the practice of pretrial custody decision procedure in foreign countries,this paper puts forward a new multilevel mode of reviewing arrest litigation,which highlights the openness,experience,pleading and relievability.
