合法性与合理性视角下的公立医院章程研究

摘要
制定医院章程是建立现代医院管理制度的重要一步,也是实施公立医院改革,提高管理水平和服务效率的关键环节。通过制定章程,公立医院将改革成果以内部规章的形式固定下来。然而,由于公立医院长期处于行政化的运营模式下,公立医院只需执行上级行政机关的制度,而无需主动制定规章,所以公立医院缺乏制定章程的经验和能力。其所制定的章程存在着一些普遍性的问题,主要表现为合法性问题和合理性问题。出现此问题即有我国卫生管理制度不完善的原因,又有公立医院自身人才单一的原因。通过从宏观上完善我国公立医院管理制度,微观上促使公立医院内部改革,以建立现代医院管理制度为根本,以保证公立医院章程的合法性与合理性。
Establishing hospital charter is an important step in establishing modern hospital management system, and also a key link in implementing public hospital reform and improving management level and service efficiency. Through the formulation of constitutions, public hospitals will fix the reform results in the form of internal regulations. However, because public hospitals have long been in the administrative mode of operation,public hospitals only need to implement the system of higher administrative organs, and do not need to take the initiative to formulate rules, so public hospitals lack the experience and ability to formulate charters. There are some general problems in the constitutions formulated by them, which are mainly manifested in the problems of legitimacy and rationality. This problem is caused by the imperfection of health management system in China and the single talent of public hospitals themselves. To ensure the legitimacy and rationality of the constitution of public hospitals, we should improve the management system of public hospitals from the macro level and promote the internal reform of public hospitals from the micro level, taking the establishment of modern hospital management system as the basis.
