摘要
区域大气污染防治联合执法是强化区域内地方政府执法协同,克服行政属地治理模式限制的重要执法机制创新。我国区域大气污染联合防治执法机制还存在指导理念欠科学、执法机构乏力、执法方式缺乏可操作性及保障机制不健全等问题。大气污染防治行政属地模式限制、地方政府竞争困境、利益平衡难题,是阻碍我国区域大气污染联合防治执法运行的主要因素。我国应以克服区域联合执法阻碍,提升区域联合防治治理整体效益,优化区域公共利益保护为目标,革新执法理念,设立权威性区域执法机构,细化区域联合防治执法方式,健全执法保障机制。
The newly revised Air Pollution Prevention and Control Law have a special chapter that stipulates coordinated prevention and control of air pollution in key areas. It formally established the legal system for joint prevention and control of regional air pollution. And its law enforcement mechanism has been stipulated,providing a basic legal basis for joint air pollution enforcement. However,the regional air pollution joint prevention and control enforcement mechanism still has problems such as lack of scientific guiding principles,law enforcement agencies,operability of law enforcement methods,and imperfect guarantee mechanisms. The restrictions on the administrative land pattern of air pollution prevention,the predicament of local government competition,and the balance of interests are the main obstacles affecting the law enforcement of regional air pollution prevention and control in China. China should overcome the law enforcement obstacles of the joint prevention and control law of regional air pollution,optimize regional public interest protection,reform the law enforcement concept,establish authoritative regional law enforcement agencies,and refine the regional joint prevention and control methods,improve the law enforcement guarantee mechanism to promote the improvement of the regional air pollution joint prevention and enforcement mechanism.
