盗墓犯罪集团及其首要分子的司法认定

摘要
近年来,盗掘古文化遗址、古墓葬犯罪呈现出了高度的职业化和集团化特征,因而需要对盗墓犯罪集团及其首要分子进行准确认定。盗墓犯罪集团具有一定的特点,实践中既要将其与一般的盗墓团伙加以区分,也要处理好其与黑社会性质组织的竞合问题。对盗墓犯罪集团首要分子的认定,应当先明确该集团中主犯的范围,而后再根据法定的成立条件,从主犯中界分出首要分子。
In recent years,the crime of stealing ancient cultural sites and ancient tombs is characteristic with a high degree of professionalism and grouping,Therefore,it is necessary to accurately identify the criminal group and its chiefs,The criminal group of the tomb stealing has certain characteristics,which must be both distinguished from the general tomb stealing gang in practice,and dealt with the problem of concurrence with the underworld organization,The identification of the chiefs of the criminal group of the tomb stealing should be done by first clarifying the scope of the principal in the group,and then dividing the chief from the principal criminals according to the statutory conditions.
