人工智能法律地位探讨

摘要
人工智能作为新时代人类智慧的产物,在现行民事法律尚未对其进行立法规制的前提下,引起了理论界、实务界对人工智能民事法律关系地位的激烈讨论。人工智能在民事法律关系中的地位如何、能否突破现行民法理论对客体范围的界定以及是否作为一种新型的民事法律关系主体意见并不一致。面对人工智能所带来的种种问题,在未来民事法律中应当借鉴国外经验,利用本土资源,制定出新的制度对人工智能进行调整,填补人工智能的法律空缺。
As a product of human intelligence in the new era, artificial intelligence has aroused hot discussions in the theoretical and practical circles on the status of the civil legal relationship of artificial intelligence under the premise that the existing civil law has not been regulated by legislation. There are different opinions on the status of artificial intelligence in civil legal relations, whether it can break through the definition of object scope in the current civil law theory and whether it is a new type of subject in civil legal relations. In the face of all kinds of problems brought by artificial intelligence, as well as in the future civil law, we should learn from foreign experience, make use of local resources, formulate a new system to adjust artificial intelligence, and fill the legal vacancy of artificial intelligence.
