排污权储备机制的法律性质探究

摘要
排污权储备机制作为排污权交易的配套制度存在诸多问题。从理论角度分析,其蕴含的法律关系过于复杂,导致其法律性质难以分辨,制度的建立缺乏理论土壤,使后续的运行举步维艰。通过对行政行为、民事行为概念、特征的阐释,寻找其与排污权储备过程中产生法律行为的契合点,区分其中产生的行政行为、民事行为,分别加以不同的制度规制、监督。同时,丰富参与的主体,形成严谨的市场准入制度,方能建立良性的排污权储备机制。
Emission right mechanism of reserves as the supporting system of emission right trading has many problems. From the theoretical perspective, the theory of legal relationship within is too complicated leading to its legal nature unrecognizable, the lack of the theoretical base for the establishment of the system and in the end it is hard to run the system and practice. Through the interpretation of administrative behavior, civil behavior concept and characteristics, this thesis will find the point of convergence with the legal behavior generated in the process of discharge of pollutants and distinguish the administrative behaviors and civil behaviors generated by them so as to impose different system regulation and supervision. At the same time, the miscellaneous participants and the strict market access system can establish a benign emission reserve system.
