审判中心主义下主办侦查员核心能力构建研究

摘要
2014年,中央提出推进"以审判为中心"的诉讼制度改革;次年,中央提出建立主办侦查员制度,其目的正是要使侦查员在"以审判为中心"的诉讼制度下更好地履行侦查机关的职能。新形势下,侦查员的职业核心能力面临新的考验。构建适应审判中心主义的主办侦查员职业核心能力模型就显得尤为重要。因此,有必要以审判中心主义为背景,以职业核心能力和侦查员相关理论为基础,构建主办侦查员职业核心能力的"回字模型",为主办侦查员制度的实施运行及主办侦查员的工作提供建议。
In 2014,the Central Government proposed to promote the reform of"trial-centered"litigation system;in the following year,the Central Government proposed to establish a system of lead investigators,whose purpose is to make the investigators to better perform the functions of the investigating authorities in the"trial-centered"litigation system.Under the new situation,the core competence of the investigators is facing a new test,so it is very important to construct the core competence model of the lead investigators to adapt to the trial-center.Therefore,under the background of the trial-center,based on the professional core competence and the related theories of investigators,the paper constructs the"clip-model"for the core competence of the lead investigators to give suggestion for the operation of the lead investigator system and the work of the lead investigators.
