摘要

人工智能技术的发展,使得人工智能体在人类控制范围之外实施犯罪活动成为可能。以自动驾驶汽车犯罪为例,刑法的适用存在主体不适格、主观罪过非契合性和因果联系差异性等问题。赋予人工智能体犯罪主体地位,使其独立承担刑事责任,并在此基础上针对人工智能体设置相应刑罚措施已成为刑法未来发展的趋势。同时,还需厘清人工智能体的研发者、使用者的监督过失责任以及利用人工智能体实施犯罪活动的刑事责任。
        The development of artificial intelligence technology makes it possible for artificial intelligence to commit criminal activities outside the scope of human control. Taking the crime of automatic driving car as an example,there are some problems in the application of criminal law,such as subject discomfort,non-conformity of subjective offence and difference of causality. It has become the trend of the development of criminal law in China to endow artificial intelligence with the status of a criminal subject and make it take the rap independently,and set the corresponding criminal penalty for artificial intelligence based on this In addition,it is necessary to clarify the responsibility of the R&D personnel and users of artificial intelligence for supervisory negligence and the criminal responsibility of using artificial intelligence to carry out criminal activities.
