农民以土地入股的风险类型及其防范机制

摘要
阐述了农民以土地入股对农业发展与土地流转的意义,概括了农民以土地入股的风险类型与风险感知,并进一步分析了农民以土地入股的风险现状与应对策略,发现各方利益不共通、信息不共享、理念不共同,直接导致了土地入股过程中出现的种种风险问题。从政府和农民视角探究了风险防范机制,提出了保障农民股东权利、完善司法救济体系、健全入股运作机制、谨慎应对特殊风险等建议。
This paper expounds the significance of farmers' land shareholding investment to agricultural development and land transfer, summarizes the risk types and risk perception of farmers' land shareholding investment, and further analyzes the risk status and countermeasures of farmers' land shareholding investment. This study finds that the interests of all parties being not common, the information being not shared, and the concepts being not common directly lead to various risk problems arising in the process of land shareholding investment. The risk prevention mechanism of farmers' land shareholding investment is explored from the perspectives of the government and farmers, and some policy recommendations are put forward as follows: safeguarding farmers' shareholder rights, improving the judicial relief system, improving the operation mechanism of land shareholding investment, and carefully handling special risks.
