建立环保责任清单的现实考量及对策

摘要
我国近年来积累的环境问题和发生的环境灾难事件要求负有环保责任的行政主体切实履职。目前,政府部门在履行环保职责时,存在过度以任务为目标、忽视公众参与、职责梳理口径不统一、程序不透明、行政效率低、责任主体及职责边界不清晰等缺陷。为此,应总结政府部门在履行环保责任实践中的经验,提高环保透明度和公众参与度;相关职能部门各管一段、发挥合力,加强监管;理清责任主体和职责边界、完善动态调整等,以期建立具有特色的环保责任清单。
The environmental problems accumulated in China in recent years and the recent environmental disaster incidents require the administrative subjects with environmental responsibility to fulfill their duties.The division of the functions of environmental protection follows the mode of the combination of unified management and assigned management in our country.At present,the administrative organs have such defects in fulfilling their environmental responsibilities as excessive task-orientedness,ignorance of public participation,disunity of responsibility review,undefined procedures,low administrative efficiency,and unclear responsibility subject and responsibility boundary.In view of the problems above,this paper puts forward some countermeasures as follows:enhancing the transparency and public participation in depth,the relevant functional departments fulfilling their respective responsibilities and cooperating with each other,strengthening supervision,clarifying responsibility subject and responsibility boundary,and perfecting the dynamic regulation.Based on the analysis of both the government's and the administrative organs' experience and lessons,a distinctive responsibility listing mode of environmental protection is supposed to be established in our country with the efficient performance of the functions of environmental protection.
