实现地方立法科学化的创新机制研究

摘要
地方立法科学化创新机制是科学立法在地方立法机制中的创新体现,是科学立法的内涵标准在地方立法过程中的融入与细化。当前影响地方立法科学化创新的障碍与困境包括地方立法体制弊端的影响、人大主导立法的格局未完全建立、设区的市立法能力与水平亟待提升、地方立法引领和保障地方治理的能力不足等。解决这些问题依然需要以创新为动力,以科学立法的要求为目标,以完善地方立法工作机制为核心,通过理顺地方立法体制、强化地方人大建设、提升设区市立法技术水平、立法对接治理实践等环节,最终实现地方立法的科学化创新。
The scientific and innovative mechanism of local legislation is the innovative embodiment of scientific legislation in the local legislative mechanism,and it is the integration and refinement of the connotations of scientific legislation in the local legislative process. The existing obstacles and dilemmas affecting the scientific innovation of local legislation include the impact of the malpractice of the local legislative system,the imperfect pattern of the NPC leading legislation,the urgent need for upgrading the municipal legislative capacity and level,and the inadequate ability of local legislation to guide and guarantee a good local governance. To solve these problems,it is necessary to take innovation as the motive force,fulfill the requirements of scientific legislation as the goal,improve the working mechanism of local legislation as the core,through straightening out the local legislative system,strengthening the construction of local people' s congresses,improving the level of legislative technology of the prefectural cities,and implementing the legislation-based governance with good links,and finally realize the scientific innovation of local legislation.
