社会变迁视角下的公民权利观演变研究——基于典型案例与事件的分析

摘要
1978年改革开放后的中国社会发生了巨大变化,于法律视角而言,其主要表现为人们的法律意识和公民的权利观念从过去的"无知""漠视"发展到"为权利而斗争":对婚姻关系中个人财产自由处分权的认可;劳资关系中劳动者对劳动力自由迁徙权的争取;亲子关系中强调对未成年人权益的保护和监护人法律责任的追究以及在社会公共事务中对他人权利的关注与呼吁等,这些变化表明现代人权利意识的增强和公民素质的提高。
Great changes have taken place in Chinese society since the reform and opening-up in 1978.From a legal perspective,the main manifestation is the evolution of people's legal consciousness and their conception of rights,which demonstrates a shift from "ignorance and disregard of their rights"to "struggle for their own rights". Specifically speaking,there are more recognition on the right to dispose personal property freely in the marital relations. Besides,the workersstarts to struggle for their rights to migrate freely whendealing with their labor relations. In addition,more concerns are given to the protection of the minors' rights and interests and the guardians are held accountable for the minors' behaviors in the parent-child relationships. There are also more concerns for other people's rights in public affairs. All these changes demonstrate the enhancement of citizen's awareness of rights and the improvement of modern citizen's quality. The article analyses the typical social cases that have been tried by judicial organs in recent years,which demonstrates that this evolution will have a positive interactive impact on the construction of the rule of law in China.
