摘要

分析了我国专利优先审查制度的历史沿革,在对比分析《专利优先审查管理办法》和《发明专利申请优先审查管理办法》新旧办法的基础上,总结了新办法的特点,并结合专利优先审查的工作实践,从优先审查请求书、现有技术或现有设计信息、相关证明文件、请求时机、申请方式5个方面提出了较为完整的专利优先审查的实施策略。
        Analyses the historical evolution of patent priority examination system in China. On the basis of comparative analysis of the new and old methods of "Patent Priority Examination Management Measures" and "Patent Priority Examination Management Measures for Inventions and Patents", it summarizes the characteristics of the new methods, and combines with the actual work of patent priority examination, from the priority examination request, the existing technology or the existing design information, and related certificates. The implementation strategy of patent priority examination is put forward from five aspects: document, request timing and application mode.
