摘要

基层社会自治具有特定的法律含义。自然村是基层社会自治的自然单元,必须培育民族地区基层社会治理的民族思维,创建民族地区基层社会治理的新模式,推动国家治理重心向农村基层下移。民族地区基层社会治理存在的主要问题是:村民委员会承担了过多的政府事务,基层政府存在严重的利益化趋势,基层社会组织治理作用发挥缺位,基层社会治理法律规范体系不完善。民族地区基层社会治理的法治举措是:构建适合农村基层社会实际的社区治理体系,完善适合农村基层社会治理实际的政府治理体系,打造适合农村基层社会治理实际的社会组织体系,建设适合农村基层社会治理实际的法律规范体系。
        The grassroots social autonomy shows specific legal implications.Natural villages are the natural unit of grassroots social autonomy.It is necessary to develop the ethnic awareness of grassroots social governance to create a new mode of grassroots social governance in ethnic areas,and promote the shift of national governance focus to the rural grassroots level.The main problems in the grassroots social governance in ethnic areas include:the village committees have undertaken too many government affairs,the grassroots government displays a serious profit-oriented tendency,the governance role is not played in the grassroots social organizations,and the legal norm system of grassroots social governance is imperfect.Accordingly,the countermeasures to ensure rule of law for grassroots social governance in ethnic areas are to build a proper community governance system for the actual rural grassroots society,improve the governance system of government to suit the actual rural grassroots social governance,create a proper system of social organization for the actual rural grassroots social governance,and build a proper system of legal norm for rural grassroots social governance.
