第一类疫苗受种者的合法权益保障——基于疫苗异常反应的法律研究

摘要
当前,《疫苗管理法(征求意见稿)》的公开征求意见为保障第一类疫苗异常反应受种者合法权益提供了新的机遇,有必要在对比研究域外其他保障模式的基础上,明确第一类疫苗预防接种属于行政法律关系;扩大行政补偿的范围,偶合症也应当予以考虑;提高行政补偿的标准,完善行政补偿的方式等。同时,探讨我国试点地区基础保险模式的理论价值和实践价值,以便能够更好地保障第一类疫苗异常反应受种者的合法权益。
In order to protect the legitimate rights and interests of recipients with abnormal response of the first type of vaccine,China has provided administrative compensation. However,administrative compensation has many problems in practice,such as unreasonable causality determination,narrow scope of compensation,and low compensation standards. In view of this,the author will conduct research on two aspects,on the one hand,to study the problems and causes of administrative compensation,and then put forward practical suggestions to improve administrative compensation,on the other hand,to explore the theoretical and practical value of other security models,so as to better protect the legitimate rights and interests of recipients with abnormal response of the first type of vaccine.
