高校升格:常见类型、潜在风险及其法律规制

摘要
梳理了我国高校升格的常见类型;分析了现阶段高校升格存在的主要问题及其潜在的风险:热潮中存在的升格标准模糊、升格过程信息不够透明和升格结果监督与救济机制缺失问题;指出了依据行政许可法的基本原则,通过科学制定高校升格标准、确保高校升格信息公开透明、加强升格过程监督与权利救济和建立预防纠正与责任倒查机制,以建立预防与纠正高校不当方式升格的法律规制。
The common types of colleges and universities in China are sorted out, and the main problems and potential risks of colleges and universities in the current stage are analyzed: the gradual ambiguous standard of upgrading in the upsurge, the lack of transparency in the process of upgrading, and the lack of supervision and relief mechanisms for the results of the upgrade; In accordance with the basic principles of the Administrative Licensing Law, it is necessary to scientifically formulate the standards for the promotion of colleges and universities, ensure the openness and transparency of the information on the promotion of colleges and universities, strengthen the supervision and rights relief of the upgrade process, and establish a mechanism for preventive correction and responsibility investigation to establish a law to prevent and correct the improper promotion of colleges and universities rules.
