经济法视角下我国快递市场监管研究

摘要
市场经济条件下的快递市场监管会出现市场和政府双重"失灵"的局面,因此经济法对于快递市场的规制尤为必要。快递市场的监管主要集中在快递市场准入和退出、快递市场竞争秩序、快递服务质量、快递安全的监管。由于快递市场监管的法律依据较为繁琐且不健全、快递行业的监管主体不明确、监管方式较为单一,因而,在完善快递行业监管法律的同时,还应当合理分配监管权限,且在监管手段上,经济法应在保持其谦抑性的前提下创新监管手段。
Under the condition of market economy, the supervision of the express market will lead to the double "failure" of the market and the government. Therefore, the economic law is especially necessary for the regulation of the express market. The supervision of the express market mainly focuses on the access and exit of the express market, the competition order of the express market, the service quality of the express delivery and the supervision of the express security. Due to express delivery market regulation law is relatively cumbersome, the regulatory agencies are not clear and the supervision method is relatively single, therefore, we should to revise the law of express regulation and rationalize the distribution of regulatory power. We also should innovate the way about the supervision and it is must be on the premise of modesty about the economic law.
