摘要
网络购物在给消费者带来更多时间和空间便利的同时,也带来了损害消费者权益的风险。中国网络购物消费者权益受损情况主要有:假冒伪劣商品损害了消费者的公平交易权,虚假信息损害了消费者的知情权,个人信息的泄露损害了消费者的隐私权。通过对中俄网络购物消费者的具体权利进行对比可知,中俄两国的法律关于消费者的后悔权、知情权、隐私权、公平交易权和求偿权等都有相关规定,但都不够完善,其中俄罗斯法律中保护消费者权益的合理措施值得我们借鉴。为完善我国网络购物消费者权益保护,应该做到:在立法层面,推动国际组织制定通用的《消费者权益保护法》,补充《中华人民共和国消费者权益保护法》,加大惩罚力度;在监管层面,加强监管部门的监管力度,强化网络平台的监管责任,发挥大众舆论的监督作用;在消费者层面,增强维权意识,增强辨假能力,妥善保管个人信息。
        While online shopping brings more convenience to consumers in time and space, it also brings the risk of damaging consumers' rights and interests. In China, the damage of online shopping to consumers' rights and interests is mainly manifested in the following aspects: fake and inferior commodities damage consumers' right of fair deal; false information damages consumers' right to know, and the divulging of personal information damages consumers' right of privacy. By comparing the specific rights of Chinese and Russian online shopping consumers, it can be seen that there are regulations in both Chinese and Russian laws on consumers' right to regret, right to know, right of privacy, right of fair deal and right to claim, but they are not perfect enough. Among them, the reasonable measures to protect consumers' rights and interests in Russian laws are worth learning from. In order to improve the protection of consumers' rights and interests of online shopping in China, we should do the following: at the legislative level, we should Promote International Organizations to formulate international Consumer Protection Act and supplement Consumer Protection Act of the People's Republic of China to increase punishment; at the regulatory level, we should strengthen the supervision of regulatory authorities, strengthen the supervision responsibility for network platform, and play the supervision role of public opinion; at the consumer level, we should enhance the awareness of safeguarding rights,improve the ability of discriminating between real and false, and properly keep personal information.
