论我国湿地保护的法律问题

摘要
湿地作为自然生态的重要组成部分,不仅具有保护生物多样性,调洪蓄洪,蓄养水源的作用,而且经济价值不可估量。长期以来人们对湿地生态价值与经济价值的认识不足,法律层面上对湿地的保护效果更是差强人意,屡禁不止的工业污染,日益扩张的城市面积,都在不断破坏和侵占湿地,致使我国的湿地现状不容乐观。由此,文章指出我国在湿地保护上的几个问题,借鉴美国、日本、英国等在湿地保护上较为领先的国家的湿地法律保护经验,提出湿地保护的法律构想,以期为实现我国湿地资源的可持续利用提供法律保障。
Wetland, as an important part of natural ecology, not only has the function of protecting biodiversity, flood control and water storage, but also has immeasurable economic value. For quite a long time, people have not fully understood the ecological and economic value of wetlands, and the legal protection effect of wetlands is unsatisfactory. Constant industrial pollution and expanding urban area have been destroying and occupying wetlands, resulting in the current not-too-optimistic situation of wetlands in China; therefore, the author of this thesis points out several problems on wetland conservation in our country, drawing lessons from the United States, Japan, Britain and other leading countries with regard to wetland legal protection, and puts forward some wetland protection legal conceptions in hope of providing legal protection for the sustainable utilization of the wetland resources in China.
