摘要

近年来,教育法治建设逐步完善,在依法治国基本方略的要求下,依法治校应当成为学校的自觉行为。本文就学校在履行各项职能过程中与在校生之间的教育行政法律关系加以分析。在厘清学校法律地位的基础上,对学校与学生教育行政法律关系进行理论溯源,对其中存在的问题予以探究,并探讨教育行政纠纷产生后有多种救济途径。
        In recent years,the construction of education rule of law has gradually improved.Rule of law should be a conscious act of the school. This paper analyzes the educational administrative legal relationship between the school and the students in the process of performing various functions. On the basis of clarifying the legal status of the school,it explores the generic and existing problems of the school-and-student administrative legal relationship,and there are many remedies after the education administrative dispute arises.
