我国农业保险法律制度存在的问题与对策

摘要
为进一步完善我国农业保险方面的法律制度,以保障农业经济健康稳定发展,介绍了农业保险的特征及性质,从监管规则和民事责任不明晰、缺乏对政府补贴与优惠政策的具体规定和农业巨灾风险分散机制不健全方面,分析了我国农业保险法律制度存在的问题,并从优化农业保险管理监督机制、细化保险补贴法律制度和完善农业巨灾风险分散机制方面提出了针对性的措施。
In order to further improve the legal system of China's agricultural insurance to ensure the healthy and stable development of agricultural economy.The authors analyzed the problems in the legal system of agricultural insurance in China from the aspects of unclear regulation and civil liability,lack of specific stipulations on government subsidies and preferential policies,and imperfect mechanism of agricultural catastrophe risk dispersion.And put forward the pertinent measures from optimizing the supervision and management mechanism of agricultural insurance,refining the legal system of insurance subsidy and perfecting the mechanism of agricultural catastrophe risk dispersion.
