国家级新区建设法治保障的域外经验与启示

摘要
域外新城建设作为中国国家级新区建设功能主义意义上的参照系,有着多元理论基础,也有着基本法治需求。典型域外新城的建设发展实践,内在蕴含着权力来源与发展规划、管理机构与运营模式、土地开发与交易转让、资金来源与财税政策、绿色发展与生态保护等方面的法治保障基本面相,同时也构成域外新城建设法治保障的基本经验。这些域外经验对中国国家级新区建设法治保障的启示有:找准功能定位,明确保障重点;坚持法治先行,规划发展方向;改革管理体制,创新运营模式;引入社会资本,激发市场活力;彰显政策优势,优化营商环境;协调人与自然,打造绿色新区。
As a reference frame of functionalism on constructing state-level new area in China, extraterritorial new-city construction has multiple theoretical basis and basic legal requirements. Typical practices for the construction and development of extraterritorial new cities inherently contain basic legal-guarantee principles in terms of power sources and development plans, administrative structure and operational models, land development and transaction transfer, sources of funds and fiscal policies, and green development and environmental protections, which in all simultaneously form the basic experiences of legal guarantee for constructing extraterritorial new cities. The implications from these overseas experiences on the rule of law guarantee for China's state-level new area construction include, but are not limited to: setting directions for its functions and clarifying the key guarantees, adhering to the rule of law first to plan developmental tendencies, reforming the administrative system while innovating the operational models, introducing social capital to invigorate the market, highlighting the priorities of the policies to optimize the business environment, and harmonizing the relationship between human and nature to build new green areas.
