生与死的博弈:厘定死刑案件量刑因子适用规则

摘要
死刑的适用不仅关系到犯罪行为人的生与死,更会对司法公信力产生重要影响,如若死刑适用失衡,则会造成公众对司法机关的不信任,动摇司法作为最后解决手段的地位。因此为了实现司法的公正、公平等价值追求,让司法裁判结果更具有社会可接受性,避免出现死刑案件的冤假错案,应该对死刑适用的量刑过程进更进一步的规范。文章针对死刑适用过程中出现的问题提出明确故意杀人罪死刑定位量刑基准、调试方法、调试尺度等系统性途径实现死刑案件量刑均衡。
The application of the death penalty not only relates to the life and death of the perpetrator, but also has an important impact on the judicial credibility. If the application of the death penalty is out of balance, the public will not trust the judiciary. To shake the status of justice as a means of last resort. Therefore, in order to realize the value pursuit of justice and fairness, to make the result of judicial adjudication more socially acceptable and to avoid the miscarriage of justice in death penalty cases, the sentencing process of death penalty should be further standardized. Aiming at the problems in the process of application of death penalty, this paper puts forward some systematic ways to realize the balance of sentencing in death penalty cases, such as defining the sentencing benchmark, debugging methods, debugging standards and so on.
