图书馆制度重构:法治思维与法治方式融合实现图书馆价值意蕴的应然选择——以“211工程”大学图书馆制度考察为例

摘要
图书馆价值意蕴最终体现为图书馆科学管理与读者权利的实现。在迄今该领域仍没有独立成文法出台的背景下,图书馆管理与读者权利等价值实现问题主要依存其制定的各项规章制度。然而当前图书馆制度环境弱化,使其治理始终徘徊在法治边缘。文章首先以"211工程"大学图书馆制度为考察对象,在检视分析图书馆制度方面存在的制度体系不完整、价值理念未能有效嵌入、内容陈旧不规范、关键性制度缺失等问题的基础上,提出了以法治思维与法治方式融合重构图书馆制度的方略。
The library value demonstrates the realization of scientific management and the readers' rights. In so far there are still no written laws in China and library management and the readers' rights mainly depend on the rules and regulations. However,Since the current library system environment becomes weak,its governance still lingers on the edge of the rule of law. This paper takes on the project 211 university libraries system as investigation object, finds some problems when analyzing library system, such as incomplete system, ineffective embedded values, outdated and no standard content,and lack of the key system,and puts forward the reconstruction strategy of library system based on the legal thought and the rule of law.
