河长制视野下的非法采砂入刑问题探析

摘要
非法采砂入刑以后,在实体上,存在法律规制效果过轻、法律规制条件不明的问题,在程序上,共享与转化机制存在法律障碍。因此,本文对此展开研究,希望借助河长制为平台来落实采砂管理责任,继续推动非法采砂入刑。通过河长的统一领导,统筹各方力量,加强部门联动形成打击合力,完善水行政执法与刑事司法的有效衔接,并通过细化裁量基准、加强程序保障等措施来严厉打击非法采砂行为。
After illegal sand mining into criminal punishment, there are problems in the entity, such as the effect of legal regulation is too light and the conditions of legal regulation is unclear. In terms of procedures, there are legal obstacles in the sharing of case information and the mechanism of evidence conversion. Therefore, this paper carries out research and hopes to implement the management responsibility of sand excavation with the help of the river chief system, continues to put illegal sand mining into penalty. Under the unified leadership of the river chiefs, all forces should be coordinated to strengthen the departmental linkages to form joint force, improve the effective connection between water administrative enforcement and criminal justice, and refine the discretionary benchmarks to strengthen the procedural safeguards to crack down on illegal sand excavation.
